Joshua Jackson and Jodie Turner-Smith have officially canceled their upcoming trial over custody arrangements for their 5-year-old daughter, Juno — just one day before they were set to appear in court.
According to court filings obtained by PEOPLE, the Tron: Ares actress’ attorney submitted paperwork on Tuesday, Oct. 14, requesting that the former couple’s divorce trial — originally scheduled for Wednesday, Oct. 15 — be removed from the court’s calendar. The filing indicates that Turner-Smith, 39, and Jackson, 47, are now working together privately to reach an agreement regarding custody.
"[Turner-Smith and Jackson] are in the process of negotiating a custody judgment. The parties will return to the privately compensated temporary judge to resolve any impasses in the proposed custody judgment," the documents state.
Since Turner-Smith filed for divorce in 2023, the pair have struggled to finalize their custody plan for Juno. Earlier this year, in June, the Doctor Odyssey actor filed an emergency motion accusing his ex of changing their daughter’s school without his consent.
In his declaration, Jackson claimed that Turner-Smith said it’s "no big deal to force Juno to start over with a new school" and expressed concern that "Jodie is attempting to create a scenario where Juno travels with her rather than attending a traditional school."
Jackson asked the court to keep Juno enrolled at her current school for the next academic year and requested that both parents share joint authority over any future school decisions. After four years of marriage, Turner-Smith filed for divorce in October 2023. The two initially agreed to share joint custody and later finalized their divorce in May 2025, with Jackson ordered to pay $2,787 a month in child support.
However, they remained at odds over Juno’s education. In documents obtained by PEOPLE, Turner-Smith noted that after a “stipulation and order to resolve the issue of selection of Juno’s school” in 2024, she was granted the authority to "make the final decision" about their daughter’s schooling — provided she first consult with Jackson.
In court filings from December 2024, Turner-Smith also alleged that Jackson had failed to make child support payments since October 2023. Speaking about co-parenting with Jackson in her GLAMOUR Woman of the Year cover story in October 2024, Turner-Smith admitted that navigating life after their split hasn’t been simple.
"It’s an adjustment period for anyone when they split up with someone because you’re used to being with your child all the time,” she said. “But nobody hands you a manual. Everyone’s trying to figure it out."
Turner-Smith continued, "Each parent has a different life, and especially if the reason why you’re splitting up is because you have different lives, it’s only further complicated by how you’re going to coparent.”
