Ashley St. Clair has hit Elon Musk with a paternity suit, seeking full custody of her 5-month-old child.

Ashley St. Clair, a conservative political commentator and children's author, is seeking to legally declare Elon Musk is the father of her child. Plus, she wants to get sole custody of her 5-month-old son, which comes after a pair of petitions she filed in Manhattan Supreme Court on Friday, February 21.

The 26-year-old brought the legal action against the billionaire businessman just one week after her public claims that she gave birth to Musk’s 13th child. In a paternity petition--which seeks to officially recognize the SpaceX and Tesla boss as the father of her baby--St. Clair claims she and the X owner conceived the child during a January 2024 trip to St. Barths.

St. Clair asked the court to issue an order requiring Musk to submit to a genetic test to determine if he is the father. Still, despite calling him out on his own platform, Elon has not publicly acknowledged his alleged youngest child.

In the court filing, Ashley included a photo of Musk holding an infant along with some flirtatious texts the pair allegedly exchanged.In a separate custody petition, St. Clair claims that Elon was not present for the child’s birth and has only met the baby on three occasions — twice in Manhattan, where she lives, and once in his home of Texas.

The custody filing also alleges that Musk has also never asked to see the baby, nor asked for photos of him. Now, St. Clair is seeking sole custody of the child, which is her second son.

In one text exchange included in the paternity petition, Ashley shares a photo of herself and her newborn son in a hospital bed. The recipient is saved in her phone as "EM," said to be Elon Musk, who simply replies, "All well?"

When St. Clair says the baby is "perfect," EM replies, “I look forward to seeing you and him this weekend,” later adding, “Falling asleep. How the recovery goes well.”

In another series of texts, EM complains that he gets “credible death threats everyday," to which St. Clair responds: “That’s why the father spot on his birth certificate is blank right now, E.” She added that’s why the child bears her last name.
